Welcome to Evend. These Terms of Service (the “Terms”) govern your access to and use of the Evend mobile application and related services (together, the “Service”), operated by the Evend team (“Evend”, “we”, “us”, or “our”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use Evend. By using the Service you confirm that you meet this requirement and that the information you provide is accurate and kept up to date.
You are responsible for keeping your login credentials secure and for all activity that happens under your account.
Evend is an online marketplace that lets users list, discover, buy, and sell trading cards and related collectibles, take part in auctions, post “wanted” requests, and message one another.
Evend is a venue and intermediary. Listings and sales are between individual buyers and sellers. Evend is not the buyer or seller of items listed by users and does not take ownership of items. We are not a party to the contract of sale formed between a buyer and a seller, except where expressly stated (for example, when we hold funds in escrow or process a refund).
Sellers are responsible for the accuracy of their listings, including the description, condition, grade, photos, price, and availability of each item, and for ensuring they have the right to sell the item.
Buyers are responsible for reviewing a listing before purchasing and for providing a correct shipping address. When you place an order and pay, you commit to completing the purchase.
All prices, fees, and payouts on Evend are in Malaysian Ringgit (MYR / RM). A shipping fee may be added per seller at checkout based on destination (e.g. West or East Malaysia).
Payments are processed by our third-party payment provider, Stripe. Evend does not store full card numbers. By paying, you agree to Stripe's applicable terms.
Eligible orders are covered by Buyer Protection. Your payment may be held in escrow and released to the seller after the item is delivered and the dispute window closes, or held until a dispute is resolved.
Where you hold voucher credit or wallet balance, it may be applied to reduce the amount charged to your card at checkout. Credit has no cash value except as applied to purchases on Evend, and is subject to any terms shown when it is issued.
Sellers must ship sold items within the timeframe shown in the order (and add tracking where required) and must not cancel or delay orders without good reason. If a seller fails to ship within the deadline, the order may be cancelled and the buyer refunded.
Buyers should confirm receipt promptly. If you do not receive an item, or it materially differs from the listing, open a dispute from the order before the dispute window closes so our team can review it.
Placing a bid is a binding commitment to buy at your bid price if you win. Winning bidders must complete payment within the time stated for the auction.
Failing to pay for items you have committed to buy (including auction wins) may result in strikes against your account and, after repeated occurrences, restriction of your ability to transact.
Listing and browsing on Evend is generally free. When a sale completes, a platform fee applies to the seller's proceeds (for example, a percentage of the sale). The applicable fee is shown in the seller tools before payout.
Sellers can request payouts of their available balance to a bank account they provide. Payouts are reviewed and processed by the Evend team and may take several business days. You are responsible for the accuracy of your payout details and for any taxes due on your earnings.
To sell on Evend you may need to apply, verify your phone number, and provide identity or business information for verification and compliance. We may approve, decline, suspend, or revoke seller status at our discretion, including where verification fails or our policies are breached.
You agree not to: list counterfeit, stolen, or prohibited items; misrepresent items or yourself; circumvent Evend to avoid fees or Buyer Protection (for example, arranging off-platform payment); harass, abuse, defraud, or spam other users; post unlawful, infringing, or harmful content; or attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
We may remove content, cancel transactions, limit features, or suspend or terminate accounts that we reasonably believe breach these Terms or harm users or Evend.
You retain ownership of the content you post (listings, photos, posts, comments, messages). You grant Evend a non-exclusive, worldwide, royalty-free licence to host, display, and use that content for the purpose of operating and promoting the Service.
You are responsible for your content and confirm you have the rights to post it. We may moderate, remove, or restrict content that breaches these Terms or applicable law.
Evend may provide tools to help resolve disputes and may, at its discretion, make a decision on a dispute (including issuing a refund from escrow). Our decision on a dispute is intended to be a practical resolution and does not remove any legal rights you may have against the other party.
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. Evend does not guarantee the quality, safety, legality, or accuracy of listings, or the conduct of users.
To the maximum extent permitted by law, Evend will not be liable for indirect, incidental, or consequential losses, and our total liability arising from the Service is limited to the greater of the fees we earned on the relevant transaction or RM100. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You may stop using the Service at any time and request account deletion via the app. We may suspend or terminate your access if you breach these Terms, create risk for users or Evend, or as required by law. Some obligations (such as completing in-flight orders, fees, and disputes) survive termination.
We may update these Terms from time to time. If we make material changes, we will update the “last updated” date and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of Malaysia, and you agree to the non-exclusive jurisdiction of the Malaysian courts.
